To whom it may concern: I (We), the undersigned individual(s), have (i) made, or am considering making, an application to become an authorized franchisee of products made or distributed by Mac Tools, a Division of Stanley Black & Decker, Inc., a Connecticut corporation, with a principal place of business at 505 North Cleveland Ave, Westerville, OH 43082 (hereinafter referred to as “Mac Tools”); (ii) entered into a Franchise Agreement with Mac Tools; (iii) applied for an account with Mac Tools; or (iv) agreed to act as guarantor for such an applicant/franchisee. I hereby authorize Mac Tools and any Working Capital Lender (as defined below) to which Mac Tools provides information about me, to make credit and background checks on me by, among other means, obtaining consumer reports from consumer reporting agencies, and by making direct inquiries of businesses where I have accounts and where I worked, and other sources. I also hereby authorize Mac Tools to report concerning any performance with Mac Tools that I may have to consumer reporting agencies and others who may properly receive such information. I hereby instruct any individual or entity, whether or not a consumer reporting agency, to provide any and all pertinent information they may have regarding me to Mac Tools in response to any inquiry or request from Mac Tools pursuant to the foregoing authorization. In that regard, this document shall constitute and be deemed to be my “written instructions” pursuant to Section 604(a) (2) of the Fair Credit Reporting Act. I hereby instruct Mac Tools to provide copies of any consumer reports and other information on me that Mac Tools has obtained to one or more lenders with which Mac Tools has a business relationship and which might provide me with financing to become a Mac Tools franchisee (any such lender, a “Working Capital Lender”), and if Mac Tools conditionally approves me as a Mac Tools franchisee, I intend to file applications for financing with such Working Capital Lender(s). It is my intention that the authorizations and instructions contained herein shall continuously remain in full force and effect so long as I have any application (including this preliminary application) pending with or obligation owing to Mac Tools.
